In the case of a fixed-term employment contract for at least 6 months, the employer is legally obliged to inform you at least one month in advance in writing whether you are going to extend the employment contract. Continuation for a fixed period is subject to a limitation in the number of contracts (max. 3) and a limitation in time (max. 36 months). If a collective labour agreement applies, it may be possible to deviate from this. If the employment contract is extended, you are also obliged to inform the employee in writing of the conditions under which you will extend the employment contract. This so-called obligation to give notice does not apply to temporary contracts with a duration of less than six months or contracts with no end date (for example, if someone is hired for the duration of a project) or to temporary employment contracts with a contractor’s clause.
